Writing a bad check to many people doesn’t seem like that big of a deal, but the reality of it is that it is a serious crime. In fact, aside from the potential monetary penalties for writing or passing a bad check, you may be incarcerated in jail for a period of time. You need an aggressive tough criminal attorney, who is not afraid of the prosecutors and is willing to go to bat for you. Call the Criminal Lawyers of Kopecky Law, P.A. today before you speak with anyone about your case. You have the right to remain silent and we suggest you take advantage of that right.
As per the Missouri Revised statutes Section 570.120, writing a bad check is the act of presenting and using a check which you know will not be any good and that you don't have sufficient funds in your bank to cover the amount issued. It is treated very similar to stealing, theft, or committing a fraud, and is therefore, very serious.
Passing a bad check is a Class C Felony if the amount of the check is more that $500, or it is a check from a bank or institution where you don't have a valid account of any kind. In the case of writing a bad check for under $500, it is a Class A Misdemeanor.
There are many defenses and forms of damage control, the primary one being that it was simply a mistake or an oversight, and you never intended to fraudulently use a check that you knew wasn't any good. We can also attempt to get the charges dismissed or reduced in exchange for restitution or payment to the victim in the case.
You are entitled to a strong defense and fair treatment under the law. Call (816)421-0100 in Kansas City, Missouri or (913)491-5599 on the Kansas side, or (314)363-8180 in St. Louis, or (800)N_GUILTY anywhere across the state, and ask to speak to one of our sharp criminal attorneys. There is no obligation and it is a free consultation. We will do everything in our power to minimize the pain you feel from your bad check charge.
